Our recent doctoral graduate Giulia Priora has just published her piece, “The Principle of Appropriate and Proportionate Remuneration in the CDSM Directive: A Reason for Hope?” in the European Intellectual Property Review

The comment analyzes Article 18 of the new EU Directive on Copyright in the Digital Single Market. By retracing the evolution of the notion of fair remuneration within the EU copyright legal framework, the author closely investigates strengths and weaknesses of the new provision. In her view, national implementation permitting, the principle of appropriate and proportionate remuneration enshrined in Article 18 CDSM Directive may result in a successful consolidation of the goal of protecting authors and performers, thus representing an effective function-based development in the modernization of EU copyright rules.
